Wickson.ai and Wickson API Terms of Service

We use these Terms of Service ("Terms") to govern your use of the Wickson API ("Service"), and any other associated websites, software, or services offered by Firespawn Studios. By accessing or using our Service(s), you agree to be bound by these Terms and our Privacy Policy.
Our Mission
At Firespawn Studios, our mission is to responsibly advance the field of artificial intelligence, media processing, and related fields. Our cross-disciplinary approach in AI, software development, and advanced manufacturing enables us to deliver innovation that we believe will help positively shape the future of AI and robotics and help businesses thrive by providing tools and insights to make these technologies easy to implement and adopt.
Our API Versioning
We follow the current semantic versioning standards.
Format: MAJOR.MINOR.PATCH (Example: 2.4.1)
- MAJOR (2.x.x): Breaking changes, incompatible API changes
- MINOR (x.4.x): New features, backwards compatible
- PATCH (x.x.1): Bug fixes, small changes
Agreement Changes
These Terms replace all previous agreements between us. We can update these Terms by posting changes on our website. Using our service after changes means you accept them. If you don't agree with changes, stop using the Service(s).
Eligibility
You must be at least 13 years old to use our Service(s) in the United States, or the equivalent minimum age in the jurisdiction where you reside, if higher. By using our Service(s), you represent and guarantee that you meet this age requirement.
Children's Online Privacy Protection
We comply with COPPA in the United States and equivalent laws in other North American jurisdictions. Our company takes steps to ensure that children's personal information is protected in accordance with these laws.
Registration
Information must be accurate when registering with our services. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. Account and credential sharing is prohibited. We handle all personal and related information provided during registration in accordance with our Privacy Policy.
Alpha/Beta Program Specific Terms
The Wickson API Beta Program ("Beta") is provided under the following additional terms:
1. Program Duration
Beta access is provided for an indefinite period and may be terminated or modified at any time.
2. Beta Features
- Features may be added, modified, or removed without notice
- Performance and availability may vary as we work to improve the services
- Beta pricing and terms may change upon full release
- Qualifying beta participants will receive a 20% lifetime discount on services
3. Beta Tester Obligations
- You agree to maintain the confidentiality of any non-public features
- Diagnostics, customer feedback, and anonymized usage metrics may be collected to improve the service
- You agree that we may contact you at your specified contact information during the beta phase
- Beta access is non-transferable
Intellectual Property
Our Service(s), including all text, graphics, images, software, and other content, is owned by Firespawn Studios or its licensors and is protected by intellectual property laws. You may not modify, reproduce, distribute, or create derivative works from our Service(s) without our prior written consent.
User Conduct and Content
You agree to use our Service(s) in compliance with all applicable laws and regulations. You are solely responsible for the content you upload. By using our Service(s) you agree that you will not:
- Use our Service(s) for any illegal or unauthorized purpose
- Upload any content that is unlawful, harmful, abusive, harassing, or defamatory
- Knowingly upload any content that contains software viruses, malware, or any other harmful code
- Attempt to gain unauthorized access to our systems or interfere with our Service(s)
- Engage in any activity that could disrupt or interfere with our Service(s)
- Assist or engage in reverse engineering of our products

While the Wickson API can be a powerful tool for research and analysis, it is not a substitute for professional advice. You assume all risks and responsibilities for any decisions made based on the output of the service. You are solely responsible for compliance with all applicable laws and regulations in your industry and jurisdiction. The service should not be used for any applications which may have a life-altering, legal, financial, or other significant impact on an individual or entity without independent human verification and judgment. By using the Wickson API for such purposes, you agree to waive any and all claims against Firespawn Studios LLC and its affiliates for any damages or losses arising from such use.
Rate Limits
To protect our service rate limits have been set in place. To review the specifics please refer to our documentation.
Subscription Billing and Refunds
The Wickson API operates on a subscription-based model. All payments are processed through our third-party payment processor, Stripe. By signing up for a subscription, you agree to the following terms:
- Billing Cycle: Subscriptions are billed on a recurring monthly basis as specified in your chosen subscription plan. Your subscription will automatically renew at the end of each billing cycle unless you cancel it.
- Payment Method: You must provide a valid payment method (e.g., credit card) to be stored with our payment processor, Stripe. You authorize us to charge your payment method for the subscription fees and any applicable taxes.
- Subscription Management: You can manage your subscription, including upgrading, downgrading, or canceling, through your account dashboard.
- Refunds: Subscription fees are non-refundable. We do not provide refunds or credits for partial subscription periods, unused services, or downgrades. In the case of a confirmed billing error, please contact us at sales@firespawnstudios.net, and we will work with you to correct the error.

- Our search and infrastructure systems
- Our API and how it works
Things You Can Do
- Use outputs or results in your business
- Change or improve the outputs or results
- Include results or outputs in your apps
- Sell products using the outputs or results
Things You Cannot Do
- Pretend our technology is yours
- Create a competing AI or Media Intelligence API using our outputs
- Use results for anything illegal or against these terms
Limitations of Service
Our Service(s) is/are provided "as is" and without warranties of any kind, whether expressed or implied. We do not guarantee the accuracy, reliability, or completeness of our Service(s) or the responses provided by our AI or other services.
Limitation of Liability
To the maximum extent permitted by law, Firespawn Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Service(s).
Termination
We reserve the right to terminate or suspend your access to our Service(s) at any time, for any reason, without prior notice, in compliance with the laws of the jurisdiction in which we operate.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of West Virginia, United States, without regard to its conflict of law provisions.
Solving Disputes
If you have an issue:
- Email us first at sales@firespawnstudios.net
- We'll try to fix it within 30 days
- If that doesn't work, the dispute goes to arbitration in West Virginia
Severability
If any part of these Terms is found to be invalid, unenforceable, or illegal, that part will be removed. The rest of the Terms will continue to be valid and enforceable.
